In these Terms & Conditions ´we´, ´our´ and ´us´ shall refer to Bijoux-Bijoux as the context requires.


Product Availability, Descriptions & Pricing

All prices are quoted in Pounds Sterling.

Our products make use of components that have been individually crafted and also components which contain natural variations in size, shape and colour. We also use components that have limited availability. From time to time we may need to adapt our designs and make component substitutions. We can not guarantee that two like items will be identical however we can say that we create each and every item with passion and that these slight variations in size, shape, colour, design and finish add to the individuality of each item that we make.

Due to the individual and handmade nature of our products some items featured may have very limited availability, be subject to long lead times or may no longer be able to be produced. We apologise for any disappointment this may cause but do not guarantee the availability of any items featured.

We aim to provide product images, descriptions and pricing information that is correct but do not guarantee the accuracy of the information. Product images are for illustrative purposes and the colour reproduction will be approximate and dependant upon the viewing medium. All measurements are approximate. We reserve the right to change, amend or withdraw any product information without notice.


Product Suitability & Safety

None of our jewellery is suitable for children under 3 years of age and we recommend a minimum age suitability of 7 years. The small parts present in all our jewellery could cause a choking hazard and should be kept out of the reach of infants and young children.

If you purchase a piece of jewellery with an infant or young child in mind (such as a christening gift) then it must be considered as a 'keepsake' item and not worn or used by the child until such time as old enough to do so safely.

Our jewellery should not be worn during play or overnight due to its delicate nature and the possible safety risks.

Product warning labels should be retained for future reference. Do not remove from item when giving as a gift.

Our earrings are not suitable for initial piercing or the healing period.


Payment

We only accept payment in Pounds Sterling.

We accept payment by most major credit and debit cards as well as by personal cheque (subject to clearance). Payment by personal cheque will delay your order due to the time taken for payment to clear. Payment by credit or debit card requires access to an email address and the Internet.

We use PayPal to provide our credit and debit card payment option. All transactions are handled directly by the PayPal systems and your credit card details are never provided to us. Any queries in relation to a credit or debit card transaction made using this option should be directed through your card issuer or PayPal.

Payment must be made using a single transaction of the correct amount. We will not accept over or underpayment in any circumstances.


Orders

We accept orders via email and phone.

To order you need to provide the following information:
  • The style code and quantities of the products you wish to order
  • Your name, address, email address and a contact telephone number
  • The required delivery address (if different from your contact address)
On receipt of your order we will send you an email to acknowledge your order. This email does not constitute acceptance of your order but simply confirms receipt and the details of your order. This email will also contain our latest pricing and availability information as well as the delivery and payment options applicable to your order.

All orders are subject to stock availability. If you order an item that is out of stock or no longer available we will inform you of this in the order acknowledgement email.

All orders must be paid for in full prior to goods being dispatched. Please allow up to 7 days for cheque payments to clear. If we do not receive payment for your order within 14 days of our order acknowledgement email being sent we will assume you wish to cancel the order.

Upon dispatch of your order we will send you an order confirmation email. We shall only be deemed to have formally accepted your order upon dispatch of the goods.

We do not have to accept your order and reserve the right to refuse your order for any reason.

We only accept orders that are placed within the UK and that require delivery to a UK address. You must not place an order unless it meets both of these criteria.


Delivery

We aim to dispatch orders within 2-3 days of full payment being received (subject to stock availability).

All orders are subject to a postage and packing charge of £4.95 per shipment. If you choose to receive your order in multiple shipments, or require multiple delivery addresses, you will incur this charge for each shipment.

All orders will be sent by Royal Mail Special Delivery. A signature will be required on delivery.

Any delivery dates quoted are estimates only and provided in good faith based upon information provided by Royal Mail.

Upon receipt of your order you must inspect the goods within 48 hours and notify us of any damage or shortages. We will not entertain any claim for damaged or missing goods unless reported within 48 hours of delivery.


Returns Policy

Orders placed without face to face contact (e.g. by email or phone) are covered by the UK Distance Selling Regulations. This gives you until 7 days from receipt of the goods in which to cancel your order.

You must follow the following procedure if you wish to exercise this right:
  • Notify us in writing (we suggest you email us) that you wish to cancel your order. Please provide your order number, the details of the items you wish to return and the reason.
  • We will email you a returns authorisation number and provide you with details of where to return the unwanted items.
  • When you have received the returns authorisation number you must return the unwanted items. You are responsible for the full cost of returning the items and for ensuring their safe delivery. All unwanted items must be returned in their new and unused condition and with all original packaging. The goods shall remain at your risk until received by us. For this reason we suggest you use a recorded and insured postal service such as Royal Mail Special Delivery. We will not accept proof of postage as proof of delivery.
  • We will issue a refund for the cost of the unwanted items (but not the original postage and packing costs) within 7 days of them being received by us - subject to them being received in an acceptable condition.
We regret that we are unable to accept the return of earrings or other pierced items for hygiene reasons - unless faulty.

We regret that we are unable to offer refunds on jewellery that has been purchased face to face - unless faulty.


Faulty Items

If you believe an item you have purchased from us is faulty then please contact us as soon as possible to discuss the problem. Do not return any goods without first contacting us and obtaining a returns authorisation number.

Goods which are faulty may be returned for a full refund within 28 days of the original purchase date only. You should keep your purchase receipt for this purpose. Outside of this 28 day period faulty goods will either be repaired or replaced, whichever is the most cost effective to us.

All our jewellery is of a delicate nature and should be worn and stored appropriately. Damage, breakage or other defects which arise as a result of excessive wear and tear, stress, impact or other miss-use will not be considered a fault.

We try to ensure that the information contained on our website is correct but do not guarantee its accuracy. We reserve the right to change, amend or withdraw any information on this website without notice.

Our website may contain links to other websites that are operated and controlled by third parties. The content of such websites is outside of our control and we accept no responsibility or liability for the content of these sites. The presence of a link does not signify an endorsement of the linked site by us.


Choice of Law

These Terms & Conditions shall be governed and construed in accordance with English law and both parties agree to submit to the exclusive jurisdiction of the English courts.


Limitation of Liability

Except in relation to liability for death or personal injury, for which no limit applies, our liability for direct loss arising out of the use of this website or in relation to the supply of any goods, whether based on contract, tort, strict liability or otherwise, is limited to the total value of the transaction under which the claim arises. In no event shall we be liable for any consequential loss whatsoever arising out of the use of this website or in relation to the supply of any goods.


Intellectual Property Rights

The jewellery designs, product packaging, text, graphics, layout, images and source code contained within this website are the property of Bijoux-Bijoux and are protected by copyright, design rights and other intellectual property rights. Permission is given to view and print from this website for the sole purpose of placing an order with us and to use the website as a personal catalogue resource for our product range. You are not permitted to use the website or any of its contents for any other purpose without prior written permission from us.

YOU MUST NOT CREATE DERIVATIVE WORKS, COPY, REPRODUCE, MODIFY OR ADAPT ANY OF OUR JEWELLERY DESIGNS OR PRODUCTS WITHOUT PRIOR WRITTEN PERMISSION FROM US.


General

If any provision included herein, in whole or part, shall be found to be invalid or unenforceable (by a court or other such competent body) the validity of the other provisions of these Terms & Conditions shall not be affected

Any failure by us to exercise or enforce any right or provision provided by these Terms & Conditions shall not constitute a waiver of such right or provision.

The headings used in these Terms & Conditions are inserted for convenience of reference only and are not intended to be part of or to affect the meaning or interpretation of any of these Terms & Conditions.

We reserve the right to vary these Terms & Conditions from time to time as we see fit. Such variations shall become effective immediately upon posting to the website. By continuing to use the website you shall be deemed to accept any such variations.

Nothing contained in these Terms & Conditions shall affect your statutory rights.
